What is a Jack3d lawsuit?
April 12, 2013 - FDA Issues Warning on Jack3d workout booster. "We are very concerned," Daniel Fabricant, the director of F.D.A.'s division of dietary supplements programs, said in a phone interview Friday. 4We think consumers should stay away from products containing DMAA."
Our experienced product-defect lawyers are currently offering free legal consultations for possible Jack3d plaintiffs. Legal experts say that the filing of these lawsuits is likely to increase significantly in the wake of the unfortunate death of two soldiers during military training and the U.S. Department of Defense’s actions in banning the sale of Jack3d at military installations. A review of the litigation already filed shows that plaintiffs are seeking to recover damages for suffering they might have incurred from the use of the supplement and also are seeking to protect possible future users from negative side effects.
The manufacturer of Jack3d, USPLabs, is accused of falsely claiming that the supplement is “safe and effective,” “university studied” and “completely legal.” These claims, which the plaintiffs say are misrepresentations and falsehoods, will be put to the test in what may become a huge class-action case in which similar claims from across the country may be consolidated before a federal judge who would oversee the litigation. Such class-action cases are common in drug and product defect cases and it is not unusual for such cases to involve settlements or jury awards that run into the hundreds of millions of dollars, based on the precedents of previous successful cases.
Because the litigation involves allegations of making false claims, misleading the public and manufacturing a dietary supplement that is synthetic, in violation of federal laws, there will likely be a detailed investigation by Jack3d plaintiffs’ lawyers in which company officials will be required to turn over internal documents and provide proof in support of their advertising and marketing claims.
Our experienced Jack3d lawyers have aggressively and successfully pursued many such defect cases on behalf of victims. Our legal team has the capability to exhaustively research the records and results involved with the development, production and marketing of products. Many of these details are not public record but they are subject to the requests of our lawyers on your behalf. There also may arise – as has occurred in other such cases -- the question of whether, in the face of reports of problems, the company became aware of defects in the product but failed to notify consumers and government regulators as required by law.
Are you eligible for a Jack3d lawsuit? Contact us as soon as possible for a free legal consultation about your case. We will review the details of your case and provide you with all of the legal options that may be available to you. If you do have a Jack3d lawsuit we can promise you that we will aggressively pursue your legal rights to recover damages for the suffering and expenses that you might have incurred. Be aware there may be legal time limits, called the statute of limitations, that could affect your case so please contact us as soon as possible.
Why is there a DMAA Ban?
For those of us who use dietary supplements there was shocking news recently: The U.S. Department of Defense announced that it is banning the sales of dietary supplements containing the ingredient dimethylamylamine, or DMAA. The ban came after the deaths of two soldiers who used the energy booster before collapsing on fitness training exercises. U.S. Army officials are now conducting an investigation into whether DMAA, found in the popular dietary supplement Jack3da, might be one of the reasons for the soldiers’ deaths. The military announcement is being closely watched in the civilian world, also, where Jack3d and another of the manufacturer’s supplements called OxyElite Pro, have enjoyed widespread sales among athletes and fitness buffs, including weightlifters, body builders, endurance athletes and among many other purchasers who use the supplements for energy boosts and fat burning.
Meanwhile, lawsuits are being filed in which DMAA plaintiffs are seeking class-action status over claims that the supplements are, indeed, life-threatening and that Jack3d “is illegal and dangerous,” and can lead to kidney and liver failures, seizures, loss of consciousness, heat injury and muscle breakdown, according to allegations made in these lawsuits.
